Premiership Women’s Rugby - Competition Terms and Conditions

These general terms and conditions apply to all competitions, prize draws, votes and polls promoted by Premiership Women’s Rugby in any media, including on television, online or social media (each a “Promotion”), together with any specific rules that apply to, and are set out in the promotion of, the relevant competition, prize draw, vote or poll (the “Promotional Information”). In the event of a conflict between these terms and conditions and the Promotional Information, the Promotional Information will prevail. Together, the terms and conditions and the Promotional Information shall be referred to as the “Promotion Terms and Conditions”.

For all Promotions, Premier Women’s Rugby Limited, a company registered in England and Wales, whose company number is 14824862, and whose registered address is 25 Eccleston Place, London, SW1W 9NF, is the promoter (“Premiership Women’s Rugby”, “we”, “us”, “our”).

By taking part in the Promotion, you accept and agree to be bound by the Promotion Terms and Conditions.

WHO CAN PARTICIPATE IN A PROMOTION?

All eligibility criteria for a Promotion will be set out in the Promotional Information.

Employees of Premiership Women’s Rugby (or other companies within the same corporate group) and their family or household members and employees of any agent or partner of Premiership Women’s Rugby professionally connected with the Promotion and their family or household members may not enter a Promotion.

HOW DO I PARTICIPATE IN A PROMOTION?

The method of entry or details of how to take part in a Promotion, including opening and closing dates and times for entries or submissions will be set out in the Promotional Information. Any entries or submissions received outside these dates and times will not be considered or counted.

The Promotional Information will also set out any other conditions of entry and submission and may specify a maximum permitted number of entries or submissions. Any entries or submissions that do not comply with the conditions set out in the Promotional Information and any entries or submissions above the maximum number of entries will not be considered or counted.

Automated or bulk entries will not be accepted and Premiership Women’s Rugby will disqualify anybody from a Promotion where we discover the entry has been made via an automated method. Premiership Women’s Rugby is entitled to select an alternative winner in accordance with these terms if the winner of a competition or prize draw has entered the Promotion via an automated method.

Our Promotions will always be free to enter unless otherwise stated in the Promotional Information, for which no purchase or payment is necessary. However, there may be additional charges applied by your mobile phone company, telephone network operator or internet service provider for certain entry methods. You should check with your mobile phone company, telephone network operator or internet service provider to find out what these charges might be and you should always obtain the bill payer’s permission before entering.

Premiership Women’s Rugby accepts no liability for any entries or submissions that are illegible, incomplete or otherwise deficient so that we cannot include the entry or submission or for entries or submissions which are not received, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. We will not accept proof that an entry was sent as proof that we received it.

HOW WILL THE OUTCOME OF A PROMOTION BE DETERMINED?

If there is a prize available for participation in a Promotion, for example in a competition or prize draw, winners will be selected as set out below, unless otherwise stated in the Promotional Information.

Winners for all prize draws are selected at random from all correct and eligible entries received by the closing date by a closed computer-generated system. Winners for any competition will be selected against the criteria set out in the Promotional Information.

If you are a winner, you will normally be notified by the method you used to enter the Promotion or by email or telephone within 28 days of the competition closing date, unless otherwise stated in the Promotional Information. You will have a specified period of time in which to claim the prize and if you do not respond within the stated period of time, Premiership Women’s Rugby shall be entitled to select an alternative winner in accordance with these terms.

We may need to verify winners’ eligibility or check identity. Failing to provide proof of eligibility or identity within a reasonable time could result in your disqualification from a competition or the withdrawal of any prize. All personal details & information you supply must be truthful and accurate.

Premiership Women’s Rugby shall be entitled, at its sole discretion, to decide whether to select an alternative winner if an entrant is disqualified from a Promotion. Any alternative winner will be selected using the same winner selection method as was used to select the original winner.

The result of a vote or poll will be established from all eligible votes or poll entries submitted between the opening and closing times of that vote or poll and received by Premiership Women’s Rugby. The outcome of the vote or poll will be revealed by Premiership Women’s Rugby after the closing time.

In the event of a tie or if the outcome of a vote or poll cannot be reasonably determined because of a technical failure or other circumstance beyond the reasonable control of Premiership Women’s Rugby, Premiership Women’s Rugby will (where possible) calculate the outcome of the vote or poll taking into account the circumstances and information available to them at the time and/or will apply contingency plans, which may be indicated in the Promotional Information, to determine the outcome of any vote or interactive poll.

Premiership Women’s Rugby reserves the right to discount votes or polls if it has reasonable grounds to suspect they have been made from unofficial third party voting services or otherwise in breach of the Promotion Terms and Conditions or to manipulate the outcome of the vote or poll.

Premiership Women’s Rugby may suspend, withdraw or re-set any voting or poll and/or may change times for voting and participating in the poll or the rules for participating in the poll or vote in its sole discretion at any time.

Premiership Women’s Rugby shall have the final decision over any winner selected of a prize draw, competition, vote or poll and will not enter into any correspondence.

WHAT PRIZES ARE AVAILABLE?

Details of the prize for any Promotion will be set out in the Promotional Information.

Prizes are awarded at Premiership Women’s Rugby’s discretion and no alternative prize will be given. The prize is non-transferable & non-exchangeable. However, we reserve the right to change the prize due to circumstances beyond our control or to offer an alternative of similar value.

Please allow 28 days for delivery of your prize from the date you successfully claim your prize.

Premiership Women’s Rugby will not accept any liability if a prize fails to reach you or you cannot take it for reasons beyond our control, or if any prize is damaged during delivery.

The terms and conditions of any third party supplier may apply and must be accepted and complied with by the winner of the prize, including any health and safety regulations which may apply.

Travel, accommodation, expenses, charges, travel insurance and any other associated costs are the responsibility of the prize winner unless otherwise stated in the Promotional Information.

If your prize involves foreign travel it is your responsibility to ensure that you hold a full & valid passport. We can't accept liability for failure to travel due to your invalid passport or other necessary travel documentation and visas.

It is your responsibility to pay any and all applicable taxes on prizes.

HOW WILL YOU USE ANY CONTENT THAT I PROVIDE AND WHAT RULES APPLY?

Some Promotions will ask you to provide text, photos, videos or other content as part of your participation. Any content that you provide (a) must not be obscene, abusive, offensive or promote or propose hatred or physical harm against anyone; (b) must not harass or bully another person; (c) must be true and honest so far as you know; (d) must not be defamatory of anyone; (e) must not use the material or content or infringe the rights or privacy of anyone else; (f) must not contain someone else's personal details or confidential information relating to other people; (g) must not promote or condone terrorism, violence or illegal behaviour.

Premiership Women’s Rugby reserves the right to refuse to accept or refuse or cease to use any content supplied by any person that in our opinion contravenes these rules.

By submitting content to participate in a Promotion, you agree to assign to Premiership Women’s Rugby all your intellectual property rights with full title guarantee and waive all moral rights in and to the content and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

This means that Premiership Women’s Rugby may use and/or exploit your submission or entry as we like.

We will use any pictures, text or sound recordings that you send to us for the purpose of operating the relevant competition and we may, but are not required to, use it to promote our business, for example by including it on our social media platforms or website.

HOW WILL YOU USE MY PERSONAL DATA?

Premiership Women’s Rugby must either publish or make available information that indicates that a valid award took place. To comply with this obligation Premiership Women’s Rugby will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who contacts [email protected] within one month after the closing date of the promotion.

If you object to any or all of your surname, county and winning entry being published or made available, please contact [email protected]. In such circumstances, Premiership Women’s Rugby must still provide the information and winning entry to the Advertising Standards Authority on request.

We will only use your personal details to administer the relevant Promotion and in accordance with our Privacy Policy and all data protection laws.

GENERAL

We reserve the right to disqualify you from Promotion if any information you provide is untruthful, inaccurate or misleading or if we consider you have breached these terms and conditions or the rules contained in the Promotional Information.

In the event of any dispute regarding these terms and conditions, the Promotional Information, conduct, results or any fault, misunderstanding, mistake or dispute concerning the operation of a competition, including the correctness or acceptability of any answers given by winners, or the operation of any technical/communications system, Premiership Women’s Rugby’s decision shall be final.

Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These terms and conditions also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the competitions offered by us.

We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control - for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.

Where a Promotion is promoted or administered on a social media platform, please note that the social media provider has no association with the Promotion and that you must also comply with the relevant social media provider’s terms and conditions.

We reserve the right to hold void, suspend, cancel, or amend a Promotion where it becomes necessary to do so or to amend these general terms and conditions and update them from time to time. Any amendments or updates will be posted on this website.

These Promotion Terms and Conditions and any dispute arising out of them (including non-contractual disputes) shall be governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
